She is charged under case number 2026 107096 CFDB with two felonies: written threats to kill or do bodily injury under Florida Statute 836.10(2), and use of a two-way communications device to commit a felony under Florida Statute 934.215.

Under Florida law, the threats charge is a second-degree felony, punishable by up to 15 years in prison, and the device charge is a third-degree felony, punishable by up to five years. Those are maximums set by statute, not a prediction of any sentence.

According to the arrest affidavit, a Volusia Sheriff's detective was told at 8 p.m. on Oct. 29 that the U.S. Secret Service had warned the agency about a threat against the president's Oct. 30 visit. The affidavit says the Secret Service passed along documents from the FBI describing an Instagram post.

The affidavit quotes the caption as "Going to the trump rally in my city tmr so I can shoot him with my glock! wish me luck guys !!" It lists the upload time as 21:43 UTC on Oct. 29, which is 5:43 p.m. Eastern.

The affidavit says investigators linked the account to Albro through subscriber information from Meta, Instagram's parent company, and from Charter Communications.

The affidavit says everyone living at the home agreed to a search for firearms, and none were found. A deputy petitioned for a temporary risk protection order.

She had a first appearance on Oct. 30. Court records show a case management conference set for Nov. 2 and an arraignment for Dec. 1.

No federal case against Albro appeared in a review of U.S. Attorney's Office for the Middle District of Florida press releases, and no federal charge has been announced.

What the sheriff's office says happened

According to the Volusia Sheriff's Office, Albro posted a selfie on Instagram on the night of Oct. 29 with a caption saying she would shoot President Donald Trump with a gun at his rally in her city the next day. Trump was scheduled to hold a midterm campaign rally at the Ocean Center in Daytona Beach at 7 p.m. on Oct. 30.

Sheriff Mike Chitwood said the agency's Domestic Security Unit and U.S. Secret Service agents went to Albro's home after the post.

Prosecutors filed a motion for pretrial detention. Law&Crime, which quoted the filing, reported that prosecutors wrote, "The defendant admitted to posting the threat."

"We are not going to tolerate threats to assassinate the president," Chitwood wrote in a Facebook post. He added, "I would strongly advise anyone else thinking of posting a 'joke' along these lines to think twice."

What the defense says

According to the affidavit, Albro began crying and told deputies she already knew why they were there. She said the post was "obviously a joke," that she doesn't own a Glock or like guns, and that she was not going to shoot anyone. She told them she took the post down after her mother called her about it.

No attorney for her has been named. She is presumed innocent unless proven guilty in court.

What isn't public yet

Still unknown: whether she has entered a plea and who her attorney is. Albro's bond status is unclear: the arrest affidavit lists no bond on one count and $2,500 on the other, while county jail records list no bond on both.
