San José, California · Arrested Oct. 28, 2026 · Santa Clara County
What the record confirms
San José police officers Raydarius Surry, 29, and Destiney Thompson, 30, surrendered late on Wednesday, Oct. 28, 2026, and were booked into the Santa Clara County jail on charges of tampering with evidence and filing a false police report, the San José Police Department said. Both posted bail and were out of custody by Thursday.
Surry has been with the department for eight years and Thompson for six. The department says the two are in a relationship.
Surry was placed on leave Sept. 2 and Thompson on Sept. 18. The department has referred both to the California Commission on Peace Officer Standards and Training for temporary decertification review while the cases are pending.
What police say happened
According to the department, Surry listed a very small baggie of suspected narcotics in his report on a May 3, 2026, arrest, but the baggie was never booked into evidence. It was set to be tested by the county crime lab.
Police say the department opened an internal investigation in August and notified Surry about the missing evidence. On Aug. 12, police say, Surry stopped a pedestrian who had no connection to the May 3 case and found a similar baggie of suspected narcotics. He allegedly seized it, took no other enforcement action, and booked it into evidence under the May 3 case number without documenting the stop.
The department alleges Thompson accessed and viewed body-worn camera footage of the May 3 arrest to help Surry plan the replacement.
Police say a review of both officers' cases, arrests and evidence bookings found no other discrepancies.
