What the record confirms

The New York Attorney General's Office of Special Investigation released body-worn camera footage on Oct. 29, 2026, from its investigation into the death of Haley Rodriguez, who died Oct. 4 after an encounter with a Town of Gates police officer in Monroe County.

According to the attorney general's office, at 1 a.m. on Oct. 4 a Gates officer driving a marked police car on Spencerport Road saw Rodriguez walking in the middle of the roadway. The officer turned on his flashing lights, stopped and got out. The office said Rodriguez was holding what appeared to be a handgun and the officer asked her to put it down and talk to him.

The office said Rodriguez allegedly pointed the apparent handgun at the officer, and the officer fired his service weapon, striking her. She was taken to a hospital, where she was pronounced dead. Local outlets identified the hospital as Strong Memorial Hospital in Rochester.

An imitation handgun was recovered at the scene, according to the attorney general's office.

Rodriguez was 27, according to WXXI News and 13WHAM.

OSI opened its investigation on Oct. 7. Under New York Executive Law Section 70-b, the office assesses every incident reported to it in which a police officer may have caused a death. The office said the footage release "is not an expression of any opinion as to the guilt or innocence of any party" or a conclusion about the case.

The Gates Police Department released its own copy of the officer's body camera video at a news conference on Oct. 16. The Monroe County Sheriff's Office is also investigating.

What officials say

Gates Police Chief Robert Long said at the Oct. 16 news conference that the officer repeatedly asked Rodriguez to put the object down before she raised it toward him. In the video, the officer can be heard saying he did not want to hurt her.

"This is a tragic incident," Long said. "There are no words. I feel bad for the family." He added, "She was somebody's daughter, somebody's sister," and said, "The officer is going through a lot as well."

Long said the object did not appear capable of firing but looked real, especially at night. The officer was placed on administrative leave after the shooting, according to WXXI News and 13WHAM.
